Terms of Service, Erudiam
This English version is a translation provided for information only. The French version is the only authentic text and prevails in the event of any discrepancy.
Welcome to Erudiam, a preparation service for EPSO competitions. These terms of service (the "Terms") set out the rules for accessing and using the website, the web application and the mobile applications for iOS and Android (together, the "Platform"), as well as the rights and obligations of the publisher and of the user.
In these Terms, "we" refers to the publisher of the Platform (Article 1) and "you" or the "User" refers to any natural person who accesses the Platform or creates an account on it.
These Terms apply as soon as you use the Platform.
When you create your account, you are asked to accept them expressly by ticking a box provided for that purpose. This box concerns the Terms only: information about your personal data is set out in our Privacy Policy, which we invite you to read but which you do not have to "accept".
Please read these Terms carefully and keep a copy of them. You can download or print them at any time from the Platform.
1. Publisher of the Platform
The Platform is published by Jean de Loynes, a natural person working on a self-employed basis (as a secondary activity), under the name "Erudiam":
- enterprise number (Crossroads Bank for Enterprises) and VAT number: BE 1043.189.468;
- address: Avenue du Préau 20, 1040 Etterbeek, Belgium;
- contact email address: support@erudiam.com;
- email address for any question about personal data: privacy@erudiam.com.
2. Purpose and applicable documents
These Terms govern access to and use of the Platform, including its free version.
They do not cover the terms of the paid offer (price, payment, duration, renewal, termination of the subscription, right of withdrawal, legal guarantees), which are set out in our terms of sale (the "Terms of Sale").
The following documents apply:
- these Terms, for any use of the Platform;
- the Terms of Sale, in addition to these Terms, for any subscription to a paid plan. In the event of a conflict on a point relating to the purchase or the subscription, the Terms of Sale prevail; on all other points, these Terms prevail;
- the Privacy Policy, which explains how we process your personal data;
- the Cookie Policy, which describes the cookies and trackers used on the Platform.
3. Description of the service
Erudiam is an online practice tool for people preparing for EPSO competitions. The Platform is available in eight languages of the European Union. Depending on your plan, it includes in particular:
- a bank of questions organised by test;
- a spaced repetition revision system, which schedules when a question is shown to you again based on your previous answers;
- mock exams and a placement test;
- a dashboard for tracking your progress;
- leaderboards between users, accessible only if you choose to take part;
- reminders in the form of notifications, only if you turn them on;
- written essay practice, with the option of sharing an essay privately with a friend of your choice;
- a "friends" feature for inviting other users;
- shared sessions, in which you take the same test as other users and compare your results;
- live sessions, hosted in real time by a subscriber, which anyone with the code can join.
Some features may be limited in number or frequency depending on your plan (for example the number of mock exams or marked essays over a given period). These limits are shown on the Platform.
The Platform is a practice tool. It is not an individual advisory service and does not replace either the official information published by EPSO or personalised coaching.
4. Conditions of access
Age
The Platform is reserved for people aged at least 15. If you are under 15, you may not create an account. If we find that an account has been created by a person under 15, we may suspend or delete it.
Personal use
The Platform is intended for an individual's practice for the competitions. Your account is strictly personal: you may not share it, transfer it or make it available to a group, an organisation or third parties, unless we have given our prior written consent.
A paid subscription may, however, be taken out and paid for by a business or a legal person (the "Business Customer") for the benefit of a natural person whom it designates (the "Beneficiary"), under the conditions of the Terms of Sale.
In that case, the Beneficiary is the User: they have an individual account and remain subject to these Terms.
A Business Customer who wants access for several Beneficiaries must contact us beforehand.
Any use of the Platform for commercial purposes, in particular to train third parties, resell it or offer it to clients, requires our prior written consent.
Equipment and connection
Access to the Platform requires a compatible device and an internet connection. Connection and equipment costs are your responsibility.
5. User account
To access all features, you must create an account by providing the information requested at registration.
You undertake to:
- provide accurate and up-to-date information, and correct it if it changes;
- create only one account. Creating several accounts, in particular to get around the limits that apply to your plan, is prohibited;
- keep your login details confidential and tell us without delay at support@erudiam.com if you suspect unauthorised use of your account;
- not impersonate another person.
You are responsible for any activity carried out with your login details, unless it results from a fault on our part or from fraudulent use that you reported to us without delay.
You can delete your account at any time from the Platform's settings, in one of two ways:
- by closing your account: the deletion becomes final after a period of 30 days, during which you can still cancel your request by writing to us at privacy@erudiam.com;
- by requesting its immediate erasure: the deletion is then final without delay and cannot be cancelled.
Your data is then deleted or anonymised in accordance with the Privacy Policy. The consequences of deleting your account for a paid subscription are set out in the Terms of Sale.
6. Rules of use
You undertake to use the Platform fairly, in accordance with these Terms and the law. In particular, you may not:
- extract, copy, reproduce, distribute or resell all or part of the question bank, the model answers or the other content of the Platform, whether manually or by means of automated tools (robots, scripts, "scraping", etc.);
- use the content of the Platform to train an artificial intelligence system or to build a competing database;
- circumvent, disable or interfere with the security measures or technical limits of the Platform, or introduce a virus or any malicious code into it;
- attempt to gain unauthorised access to accounts, data or systems that are not yours;
- deliberately overload the Platform's infrastructure;
- present yourself as affiliated with EPSO, an institution of the European Union or Erudiam, or give the impression that the Platform is endorsed by them;
- publish or communicate on the Platform any content that constitutes the confidential text of official tests whose disclosure is prohibited;
- use the Platform for unlawful or fraudulent purposes, or for purposes contrary to public order or morality.
These prohibitions apply without prejudice to the rights that the law grants to the lawful user of a database (see Article 8).
7. Social features and user content
The Platform allows you to enter or send content: username, answers, written essays, friend requests, sharing an essay with a friend, display name in a live session, etc. (the "User Content").
Your warranties
You retain the rights to your User Content. You warrant that you hold the rights needed to use it on the Platform and that it infringes neither the law nor the rights of third parties (copyright, privacy, image rights, etc.). It must not be unlawful, insulting, defamatory, discriminatory, hateful or misleading, and must not contain personal data of third parties without their consent.
Licence
You grant us, free of charge and on a non-exclusive basis, for the life of your account, the right to store, reproduce, process and display your User Content solely to the extent necessary to provide the Platform (including to display it to the people you have chosen, for example a friend with whom you share an essay) and to ensure its security. We do not use your User Content for any purposes other than those described in the Privacy Policy.
Username and leaderboards
If you take part in the leaderboards, you appear in them under a username and not under your name. You can choose whether or not to take part, and change this choice at any time in the settings.
Friend requests
You are not obliged to accept a friend request. Requests that remain unanswered are deleted after 30 days.
Shared sessions and live sessions
In a shared session, your username (or, failing that, the display name of your profile), your scores and your avatar are visible to the other participants.
A subscriber may host a live session that anyone with the code can join, with or without an account. By taking part, you agree that the name you choose, your score and your rank are displayed to the host, to the other participants and on the presentation screen. Your photo and the other information in your profile are only displayed if you choose so. The host undertakes to use the results only for running the session. These Terms apply to participants without an account for their use of the session.
Reporting
If you come across content that you consider unlawful or contrary to these Terms, you can report it to us at support@erudiam.com, stating precisely which content is concerned and the reasons for your report. We review reports within a reasonable time and may remove or disable access to content that is manifestly unlawful or contrary to these Terms, informing you accordingly unless the law prevents us from doing so.
8. Intellectual property
Rights in the Platform
The Platform and its elements (structure, interfaces, software, texts, questions, model answers, explanations, graphics, databases, the Erudiam name, logo and distinctive signs) are protected by intellectual property law. Unless otherwise stated, all rights are reserved. No ownership rights are transferred to you.
To the extent that it meets the legal requirements, the question bank constitutes a database of which we are the maker.
As such, we have the right to prohibit the extraction or re-use of all or a substantial part of its contents, as well as the repeated and systematic extraction or re-use of insubstantial parts where this conflicts with a normal exploitation of the database or unreasonably prejudices our legitimate interests (Article XI.307 of the Code of Economic Law).
Licence to use
Subject to compliance with these Terms, we grant you a personal, non-exclusive, non-assignable, non-transferable and revocable right to use the Platform, for the User's individual practice for the competitions, for the duration of your access. Any other use, in particular commercial use, requires our prior written consent.
Rights of lawful users
These Terms do not limit the rights that the law grants to the lawful user of a database, in particular the right to extract or re-use insubstantial parts of its contents.
References to EPSO and the institutions
Erudiam is an independent service.
It is neither affiliated with the European Personnel Selection Office (EPSO) or any institution of the European Union, nor endorsed or sponsored by them. The names of and references to EPSO and the institutions of the European Union are used for purely descriptive purposes, to indicate the subject of the preparation offered, and remain the property of their respective owners.
9. Artificial intelligence and automatically generated content
Some features of the Platform (for example the marking of, or comments on, written essays) rely on artificial intelligence systems.
Where content is generated automatically, it is flagged as such on the Platform.
Automatically generated content is an educational aid. It may contain errors, approximations or omissions and constitutes neither an official assessment nor a guarantee of results. We invite you to check it and to refer to EPSO's official information.
The Platform does not take any decision producing legal effects concerning you based solely on automated processing. The spaced repetition revision system is used solely to organise your revision. The processing of the data concerned is described in the Privacy Policy.
10. Educational nature of the service
The questions, model answers, mock exams and other content of the Platform are provided for practice purposes. They are designed to help you prepare, but they do not necessarily reproduce the content, format or level of difficulty of the official tests, which may change.
Only the information published by EPSO is authoritative as regards the conduct of the competitions.
11. Availability and development of the Platform
We use reasonable endeavours to make the Platform continuously accessible, but we do not guarantee uninterrupted access or that it will be free from errors.
Access may be suspended, in particular for maintenance, updates or security operations, or because of incidents affecting our technical providers or the communication networks. We endeavour to limit the duration of these interruptions and, where possible, to inform you in advance.
We may develop the Platform (adding, changing or removing features or content) in order to improve it, to adapt it to changes in the competitions or to comply with the law. The consequences of such a change for a paid plan are governed by the Terms of Sale.
12. Suspension and deletion of an account
If you breach these Terms or the law, we may, in proportion to the seriousness of the breach: send you a warning, remove content, restrict certain features, suspend your account temporarily or delete it.
Except in an emergency or where required by law, we inform you by email of the reasons for the measure and allow you to submit your observations by replying to that email or by writing to support@erudiam.com. If your reply shows that the measure is not justified, we lift it. In the event of a serious breach (for example fraud, an attack on the security of the Platform, or manifestly unlawful content), the suspension may take effect immediately.
The consequences of a suspension or deletion for a paid subscription are governed by the Terms of Sale.
13. Liability
Obligation of means
We are bound by an obligation of means (best endeavours) as regards access to the Platform and the provision of its features.
No guarantee of results
We do not guarantee that using the Platform will enable you to pass a competition, obtain a particular score or obtain a job. Your success depends on many factors beyond our control, in particular your own work and EPSO's decisions.
Accuracy of content
We take reasonable care in preparing and updating the content, but we do not guarantee that it is free from errors or up to date with every change in the competitions. If in doubt, EPSO is the official source.
Limits
To the extent permitted by law, we are not liable for indirect or unforeseeable damage (such as loss of a chance, failure in a competition, loss of time or data), nor for damage resulting from use of the Platform that does not comply with these Terms, from your equipment, from your connection, from the act of a third party or from your own fault.
Exceptions
Nothing in these Terms excludes or limits our liability in the event of wilful misconduct (fraud), gross negligence or personal injury, nor for the rights that the law grants you as a consumer and from which no derogation is possible. Liability relating to the paid offer is supplemented by the Terms of Sale.
External links
The Platform may contain links to third-party websites, whose content we do not control and for which we are not responsible.
Your liability
You are responsible for your User Content, for keeping your login details confidential and for the use you make of the Platform.
14. Force majeure
We are not liable for any failure or delay in performing our obligations where this results from force majeure within the meaning of Article 5.226 of the Civil Code, that is, an impossibility of performance that is not attributable to us, given the unforeseeable and unavoidable nature of the obstacle.
Performance is then suspended for as long as the temporary impossibility lasts. We inform you within a reasonable time as soon as we become aware of such a cause.
15. Paid offer
Some features are available only with a paid plan. Subscription, price, payment, duration, renewal, termination, the right of withdrawal and the applicable guarantees are governed exclusively by the Terms of Sale, which you are invited to read before subscribing.
16. Personal data and cookies
Personal data is processed in accordance with the applicable regulations.
Information about the processing operations, purposes, recipients, retention periods and your rights is set out in the Privacy Policy.
The cookies and trackers used on the Platform are described in the Cookie Policy.
17. Communications
We may send you messages relating to the operation of the Platform (account confirmation, security, changes to these Terms, replies to your requests).
Revision reminder notifications are only sent if you have turned them on, and you can turn them off at any time in the settings of your device or of the Platform.
Any promotional communication requires your prior consent.
18. Changes to these Terms
We may change these Terms, in particular to take account of a change in the Platform, the law or case law.
In the event of a substantial change, we inform you by email or by a notice visible on the Platform at least 30 days before it takes effect.
The applicable version is the one in force on the date you use the Platform.
19. General provisions
Severability
If any provision of these Terms is declared void or unenforceable, the other provisions remain in force, and the provision concerned is replaced, as far as possible, by a valid clause with equivalent effect.
No waiver
Failure to exercise a right provided for in these Terms does not constitute a waiver of that right.
Assignment
We may assign or transfer our rights and obligations under these Terms to a third party, provided that this does not diminish your rights. You may not assign yours without our prior written consent.
Evidence
The data recorded in our systems (connection logs, acceptance of these Terms, actions on your account) may be used as evidence. You may provide evidence to the contrary by any means.
Entire agreement
These Terms, together with the documents referred to in Article 2, constitute the entire agreement between you and us concerning the use of the Platform. The article headings are given for ease of reading and have no interpretative value.
20. Governing law and disputes
These Terms are governed by Belgian law.
If a difficulty arises, we invite you first to contact us at support@erudiam.com so that we can seek an amicable solution. The arrangements for consumer mediation for disputes relating to the paid offer are set out in the Terms of Sale.
Failing an amicable solution, the Belgian courts have jurisdiction. If you are a consumer residing in the European Union, this rule does not deprive you of the protection afforded to you by the mandatory provisions of the law of your country of residence, nor of the right to bring proceedings before the courts that have jurisdiction under the rules applicable to consumers.
